ISLAMABAD: Supreme Court (SC) rejected plea seeking stay over NA-91 Sargodha re-polling result and served notice to attorney general for Pakistan into the matter.
A three-member bench, headed by Justice Sheikh Azmat Saeed, heard the case filed by Zulfikhar Bhatti, an candidate from the same constituency.
At the outset of hearing, Justice Azmat Saeed inquired about recounting in the constituency as directed in the previous hearing of the case.
The counsel for petitioner Zulfikhar Bhatti informed the court that the process of recounting could not be completed as it was in the constituency.
He said during recounting of votes it was noticed that polling bags were tempered and the report was sent to Election Commission of Pakistan (ECP) in this regard.
The ECP, keeping in view the tempering in polling bags, ordered re-election on 20 polling stations of the constituency, he added.
Justice Ijaz Ul Ahsan asked the counsel whether his client participated in the re-election process.
The counsel for Bhatti informed that his client participated in the re-election process and also filed a petition in the Lahore High Court.
Justice Azmat Saeed said the re-election result could be challenged before the election tribunal.
He asked whether ECP can order re-election after passage of 60 days. If the court accepted the jurisdiction of ECP then what election tribunals would do, he added.
He said the court would have to issue notice to the attorney general for Pakistan into the matter.
Later, the court issued notice to the attorney general for Pakistan and adjourned hearing of the case till February 28.
