IHC directs lower court to decide Behria Enclave plea within 15 days

ISLAMABAD: The Islamabad High Court (IHC) directed a lower court to decide a petition regarding alleged illegal possession by Behria Enclave housing society on Capital Development Authority (CDA)’s land and disposed off the Authority’s plea.
Justice Miangul Hassan Aurangzeb resumed hearing on a petition filed by CDA against the stay order issued by the lower court to the housing society.
During the course of proceeding, the CDA’s Lawyer Kashif Malik informed the court that Behria Enclave management had occupied the CDA’s land in its housing society. The housing society, he said, had succeeded to obtain a stay order from the lower court before the action of the civic body against the encroachments. He prayed the court to turn down the stay orders of the lower court so that the authority could take actions against the illegal possessions.
After hearing the arguments, the bench directed the concerned court to decide the matter within fifteen days and disposed off the CDA’s petition.
