CJP Qazi Faiz Isa takes up Military Courts and General Elections case in SC

In Islamabad, Chief Justice of Pakistan (CJP) Qazi Faez Isa took action on Friday by establishing two separate benches to address specific legal matters concerning the delay in general elections and the trial of civilians in military courts.

The first bench, comprising three members and led by Chief Justice Qazi Faez Isa, includes Justices Athar Minallah and Amin ud Din Khan. This bench has been assigned the responsibility of addressing pleas related to the delay in general elections and is scheduled to convene on October 23.

Simultaneously, Chief Justice Qazi Faez Isa assembled a six-member bench to deliberate on the pleas challenging the trial of civilians in military courts. The members of this bench include Justice Mazahar Ali Akbar Naqvi, Justice Muneeb Akhtar, Justice Aijazul Ahsan, Justice Yahya Afridi, and Justice Ayesha Malik. This bench is slated to consider issues related to military trials on the same date, October 23.

It's worth noting that the previous instance where a six-judge Supreme Court bench reviewed challenges to civilian trials in military courts occurred on August 3. During that session, a request for the formation of a full court bench to address these concerns was denied by the Supreme Court. The then CJP Bandial explained that the bench had discussed this request, but due to summer vacations, the formation of a full court was not available until September.

Additionally, Attorney General of Pakistan (AGP) Mansoor Usman Awan had submitted a list containing the names of 102 suspects held in military custody to the court.

This list highlighted various individuals involved in incidents such as breaking into the General Headquarters in Rawalpindi, attacking an army institute, assaulting the Lahore corps commander's residence, attacking army garrisons in Multan and Gujranwala, and targeting an ISI office in Faisalabad, among other offenses.
