Imran Khan faces yet another punch from the IHC

The Islamabad High Court rejected the Chairman of PTI's request against the appointment of the judge who heard the cipher case against him.

Chief Justice Amir Farooq of the Islamabad High Court issued a written judgment on Chairman PTI's request for the appointment of Judge Abul Hasanat Muhammad Zulqarnain as the official Secretariat Act judge.

The written decision stated that Chairman PTI challenged the notification of the judicial appointment on June 27, 2023, and according to the record, Chairman PTI's jail trial was considered a threat. The reasons for Chairman PTI's jail trial are of a genuine nature, while the jail trial's decision is not apparently based on malice.

According to the decision, there is no legal flaw in the appointment of a special court judge under the Official Secretariat Act, and it is not correct to say that EO (Special Courts) misused their authority while issuing the notification. The responsibility of the Official Secretariat Act is not contrary to the interests of Special Courts under Section 13; a magistrate of a higher level can make appointments under the Official Secretariat Act.
