SC reserves verdict on review appeal over dismissal of petition on Kalabagh dam

ISLAMABAD: (APP) The Supreme Court on Monday reserved its judgment in a review petition filed against dismissal of a constitutional petition seeking construction of the Kalabagh dam.

The court also granted one-week time to the petitioner to submit a written reply over his review appeal regarding Kalabagh dam construction.

The three-member bench of the apex court headed by Chief Justice Anwar Zaheer Jamali heard the case.

During the course of proceedings, Petitioner AK Dogar said that the court reserved its verdict in the case without hearing his stance.

He said that the court has dismissed the issue on technical grounds instead of examining it in light of public interest.

He was of the view that the judge can give orders to parliament in case of public interest.

Justice Gulzar Ahmad remarked that Kalabagh dam issue has been politicized and three provinces were not in favour of its construction.

He remarked that it is a policy matter and the court would not intervene in policy matters.

Chief Justice Anwar Zaheer Jamali stated that the court will not interfere in policy matters as no one's right is undermined whether the dam is constructed or not.

A K Dogar told the court that it was a matter of basic human rights under Article 184/3.
