ISLAMABAD: The Supreme Court directed Capital Development Authority (CDA) to pay Rs 23 lac to Survey General of Pakistan for providing services in Bani Gala encroachment case within a month.
A three-member bench headed by Chief Justice Mian Saqib Nisar and comprising Justice Ijazul Ahsan and Justice Sajjad Ali Shah also emphasised to pay regularisation fee of the land.
The chief justice remarked that properties would be demolished if their owners failed to pay the regularisation fee.
He also remarked that how would it be possible that without paying regularization fee, CDA regulate all the properties.
He also observed that CDA allowed construction in Bani Gala’s Zones 3 and 4 without a master plan. Meanwhile, counsel for Survey General of Pakistan informed the bench that CDA was not paying Rs. 34 lac to the department against providing survey of Korang Nala.
The chief justice directed CDA to pay Rs 23 lac to the department.
Meanwhile, counsel for the premier argued that the regularisation charges were too high and should be affordable for people living there.
The bench adjourned further the hearing till November 22.
