LAHORE: (APP) A Lahore High Court division bench on Thursday acquitted three condemned prisoners involved in a double murder case.
The division bench headed by Justice Sadaqat Ali Khan acquitted convicts including Sana Ullah, Tanveer Ahmad and Muhammad Boota for lack of evidence against them while allowing their appeals against the conviction.
During the proceedings, the defence counsel submitted that a Lahore sessions court awarded death penalty to the convicts for killing Khurram Shahzad and Umar Daraz in the limits of Shafiqabad police station in 2008. He said that the incident took place at midnight and the circumstances did not confirm the presence of eye-witnesses.
But, the trial court awarded death penalty to all the convicts despite the fact that there was no solid evidence which showed that the convicts was responsible for or associated with the murder, he added. He pleaded the bench to acquit the convicts after setting aside their death sentences.
However, the prosecution opposed the request and contended that the trial court awarded death penalty on merit after recording statements of the eye-witnesses.
He further maintained that the convicts were also found guilty in investigation.
The bench after hearing arguments of parties allowed the appeals and acquitted the convicts.
