Kulbhushan Jhadav case in ICJ: Pakistan takes an important decision

ISLAMABAD: Pakistan has decided to file a second counter-memorial in theInternational Court of Justice (ICJ) regarding the conviction of Indian spyKulbhushan Jadhav.

Earlier on January 23, the ICJ had given a timeline to both India andPakistan for filing another round of memorials.

Pakistan’s counsel Khawar Qureshi briefed Interim Prime Minister (PM)Justice (R) Nasirul Mulk regarding the case last week.

Attorney General (AG) Khalid Javed Khan and other senior officials werealso briefed during the meeting.

India had already submitted its second memorial in the ICJ earlier on April17.

Earlier in December 2017, Pakistan had dismissed India’s plea at theinternational court seeking consular access to the Indian spy, saying theprovision of such an access under the Vienna Convention is only forlegitimate visitors and not for spies.

Submitting counter-memorial in the ICJ, Pakistan had said that since Indiadid not deny Jadhav was travelling with an assumed Muslim name, they haveno case to plead.

“Lack of explanation on how a serving naval commander was operating undersecondment to Indian spy agency Research and Analysis Wing (RAW) wastravelling under an assumed name leads to only one conclusion that Indiawanted consular access to the information he had gathered,” the Pakistanireply stated.

“Only a state which adheres to legitimate actions can request the court tointervene in a matter between two states,” Pakistan had also stated.

Moreover, Pakistan had granted permission to the mother and wife of theIndian convicted spy to meet him on December 25.

Jadhav was arrested from Balochistan in March 2016 in a jointcounter-intelligence operation.
