Lahore High Court verdict in Gullu Butt case

LAHORE: (APP) A Lahore High Court (LHC) division bench on Thursday set aside five-year sentence awarded to Shahid Aziz, alias Gullu Butt who was arrested under Anti-Terrorism Act 1997 by the trial court.
However, the bench dismissed the plea to set aside sentences granted under sections 186, 353, 427, and 506 of the Pakistan Penal Code (PPC).
The bench, headed by Justice Muhammad Tariq Abbasi, passed these orders while partially allowing an appeal, filed by Shahid Aziz against his 11 years and 3 months sentence by an anti-terrorism court.
During the hearing, petitioner's counsel Syed Kashif Abbas Zaidi, maintained that the trial court awarded the sentence without appreciating the case facts and pointed out that his client had already completed his sentence awarded under sections 186, 353, 427, and 506 of the PPC.
He submitted that his client's act did not invoke the ATA section as the trial court did not award any punishment to him under sections 324 and 440 of the PPC.
The bench, after hearing arguments, agreed with the appellant counsel stance and set aside the sentence awarded under the ATA section.
