ISLAMABAD – Islamabad High Court issues 24 page written order in PervaizMusharraf treason petition.
The Islamabad High Court has issued a written order to stop the verdict ofMusharraf treason case. The IHC Chief Justice has issued a 24-page writtenorder, in which he stated the reasons for closing the ruling of the treasoncase. The written decree stated that there are unique, unusual andunprecedented circumstances in the case.
The written order read that the federal government and the prosecution havean important role to play in the treason case.
The federal government has full authority to appoint the prosecutor and theprosecution team. The fair trial is also entitled to prosecution as well asthe accused.
The IHC’s written statement stated that the federal government only filedthe complaint of emergency 2007 rather than the 1999 treachery. “Thisaction further increased the burden of fair trial on the judiciary”, itread.
In addition, the written decree stated that Musharraf cannot be denied theright for defense despite being a fugitive. It further read that theSupreme Court did not prevent the court from ruling on Musharraf’sacquittal request.
It added that the testimony cannot be recorded if Pervez Musharraf is notpresent.
The court remarked that it relies on trial prosecution from the beginningof the case to the end. The special court cannot decide a treason casewithout hearing the prosecutor.
The federal government should be given adequate time to argue before theverdict is given, added the court.
