The Supreme Court (SC) postponed the hearing of Pakistan Tehreek-e-Insaf(PTI) leader Imran Khan’s petition against the NAB amendments to the nextday. The Chief Justice of Pakistan (CJP), Umar Atta Bandial, madenoteworthy remarks during the case’s proceedings, highlighting changes inthe definition of “benamidar” within the NAB amendments.
The focal point of concern revolved around the issue of assets beyond one’sapparent means and the necessity to establish that these assets wereacquired through corrupt practices.
CJP Umar Atta Bandial emphasized the pivotal role of action against”benamidar” in the realm of accountability, stressing the importance ofconfirming that assets were not accumulated through corrupt means. MakhdoomAli Khan Advocate presented an argument before the court, asserting thatit’s insufficient to merely level accusations of corruption against a”benamidar” without concrete evidence. The Chief Justice intervened,pointing out that the court’s responsibility is to align the legalframework and suggesting that the gravity of having assets beyond knownsources should be reconsidered as a criminal offense.
Justice Mansoor Ali Shah interjected, asserting that the evaluation ofParliament’s legislation was within their jurisdiction, implying that theSupreme Court should defer the matter to the newly elected assembly.Meanwhile, lawyer Khawaja Harris addressed the court, signaling that theNAB amendments applied retroactively have already undergone their dueprocess. The implication here was that the chapter of amending the NABlegislation was now concluded, at least from Khawaja Harris’s perspective.
