ISLAMABAD: (APP) The Islamabad High Court (IHC) Thursday clubbed all identical petitions challenging the cancellation of Grant Hyatt Hotel's lease by the Capital Development Authority (CDA).
The single bench of Justice Athar Minallah issued the directive to the Registrar Office while hearing nine identical petitions filed by stakeholders having flats in the Hotel.
Eighteen identical petitions were also filed on August 23 which will also be heard together by the same bench.
Barrister Khuram Hashmi, counsel for the petitioners, pleaded the court that his clients were directly affected by the CDA's action. The CDA should have taken action at the time when any irregularity had occurred, however, now it was too late, he maintained.
The court adjourned the hearing till September 7 when it will also take up the main petition of BNP (Private) Limited, owners of the Grand Hyatt Hotel against the cancellation of 99-year lease by the CDA due to violation of its by-law.
It may be added that the same bench allowed the CDA to file reply till September 7 in the instant matter.
The IHC also maintained its restraining order regarding any development in the pertinent matter, such as construction or demolition of the hotel till next hearing.
