Toshakhana case: PTI Chairman Imran Khan receives a big setback

In Islamabad, the bench established to hear former Prime Minister ImranKhan’s petitions in the Al-Qadir Trust and Toshakhana cases was dissolvedon Wednesday due to Justice Babar Sattar’s recusal.

Chief Justice Aamer Farooq and Justice Sattar initially heard the case inthe presence of Imran’s counsel, Latif Khosa.

During the hearing, the court asked Imran’s counsel if his detentionshould be regarded as an arrest, to which Khosa responded that NAB followsits own procedures and has stated that Imran was not officially arrested.

Khosa explained that NAB typically issues an arrest warrant, and the NABprosecutor confirmed the existence of such a warrant for the formerpremier. When inquired about the delay in NAB’s investigation, the NABprosecutor explained that investigations in both cases are ongoing.

Dissatisfied with the proceedings, the bench decided to transfer the caseto another bench. Justice Farooq mentioned that on November 6, JusticeTariq Mehmood Jahangiri would schedule the case for the same day. JusticeBabar Sattar questioned why an investigation was not initiated when anindividual had been arrested.

Imran’s counsel requested the restoration of interim bail, which was deniedby Justice Babar due to Imran’s current arrest.

Khosa pointed out that a second bench of the same court had alreadyrestored interim bail in six cases. The new bench will consist of CJ AamerFarooq and Justice Tariq Jahangiri.
