Justice Qazi Faez Isa presidential reference verdict announced by SC

Islamabad: Supreme Court of Pakistan has termed a reference filed byPresident of Pakistan against Justice Qazi Faez Isa as constitutional asthe top court has issued a detailed verdict in the case.

“The present constitutional challenge made by the Petitioners representingthe entire lawyers’ community of the country, have been able tosuccessfully establish that the worthy President grossly failed to exercisehis discretion as mandated under the Constitution and, thus, the entireprocess built thereon leading to the 224 Const. P.17 of 2019, etc. filingof the Reference was in violation of the law and the Constitution,” readthe 224-page deatiled verdictlinkpennedJustice Umar Atta Bandial.

The apex court further ruled that the reference against the judge cannot bedeclared that it was based on mala fide intentions.

It further said that the reference was filed on the basis of Londonproperties and not the Faizabad sit-in case.

It further said that there is no section which states that referenceagainst a judge should be secret. The investigators can brief the presidentbut not advise him, the court said.

On June 19 this year, a full bench of the top court had nullfied thereference by issued a short order.

Background of Presidential reference

On June 2, 2019, the Supreme Judicial Council (SJC) had initiated theproceedings against Justice Faez Isa for owning foreign assets.
