ISLAMABAD – The Supreme Court Wednesday dismissed the Bahria Town’s requestto defer payment over withdrawal of petition.
A three-member special bench of the court comprising Justice Ijaz Ul Ahsan,Justice Faisal Arab and Justice Munib Akhtar heard the Bahria Town KarachiImplementation case.
During the course of proceedings, Advocate Ali Zafar counsel for the BahriaTown said that the Bahria Town had paid installments till November.
Justice Faisal Arab said that once the payment had been made, the requestto defer installments was premature.
Ali pleaded the court to delay payment due to coronavirous for one year.
Justice Munib Akhtar said that the business community had received a lot ofrelief because of coronavirous.
Justice Ijaz Ul Ahsan said that a court decision was not an agreement thatcould be changed over time. The implementation bench did not have the powerto overturn a court decision, he added.
Barrister Ali Zafar said that the implementation bench would also decide togive the money to the government.
Justice Munib Akhtar said that the Bahria’s job was to submit the money tothe court, not to see where it would be spent.
Ali Zafar said that the Bahria Town would go bankrupt if it continued thepayment of instalments.
Justice Faisal Arab asked the counsel that his request was currentlypremature.
Ali said that the application would be re-filed in due course.
SC accepts appeal of Haripur jail employee seeking reimbursement: TheSupreme Court on Wednesday accepted the appeal of Haripur Jail employeeAbdul Sattar seeking reinstatement.
A two-member bench of the court comprising Chief Justice Gulzar Ahmed andJustice Ijaz Ul Ahsan heard the case.
During the course of proceedings, Justice Ijaz Ul Ahsan addressing theaccused said that four prisoners broke out of the jail and escaped duringhis duty. He said that accused’s job was to search the prisoners.
He said that three courts found the accused guilty.
The chief justice said that four accused escaped while the accused was onduty inside the jail. He said that twenty-one employees, including theaccused, who were on day and night shifts duties were held responsible.
He said that the four accused escaped by cutting the prison bars.
The counsel for accused Abdul Sattar said that his client was on dutyduring the day while the accused had fled at night.
The court accepted the petitioner’s appeal and directed that the case befixed for hearing after three months. Four accused escaped from HaripurJail in 2012.
