The Islamabad High Court (IHC) has issued a written order, staying the jailtrial of PTI Chairman Imran Khan in the cipher case. This order, issued byJustice Miangul Hasan Aurangzeb and Justice Saman Riffat, highlightsconcerns about the nature of the trial.
The court’s order suggests that, upon reflection, the jail trial of thecipher case cannot be characterized as an open trial. It points out theabsence of documented evidence indicating that the pre-conditions for ajail trial have been met.
The order specifically requests the production of any such document duringthe next hearing.
According to the order, the attorney general for Pakistan (AGP) stated thatthe federal cabinet had approved the jail trial of the case. However, thecourt noted that the AGP failed to produce a copy of the cabinet decisionduring the proceedings.
Furthermore, the AGP was unable to present the summary upon which thecabinet based its decision. The order emphasizes the necessity of havingthe required documents on record to ensure a just decision.
