IHC verdict on Imran Khan petition in Cipher case

The Islamabad High Court (IHC) has reached a pivotal juncture in the caseinvolving former Prime Minister and PTI Chairman Imran Khan’s petitionagainst the US cipher case proceedings at District Jail Attock as the IHC’sdecision to reserve its verdict on Tuesday. Chief Justice Aamer Farooqpresided over the proceedings, which saw an intriguing twist during thehearing.

Imran Khan’s legal representative, Sher Afzal Khan Marwat, informed CJFarooq that the former Prime Minister was currently engaged in anothercourt session but would arrive shortly. He urged the prosecution to proceedwith their arguments, assuring them that he would represent Imran Khan’sinterests in the meantime. However, CJ Farooq insisted on contacting Marwat.

Subsequently, PTI Chairman’s counsel appeared in court and raised questionsregarding the Ministry of Law’s decision to transfer the court proceedingsto Attock Jail. He queried the legality of such a transfer, asserting thatonly the Supreme Court had the authority to order such a relocation. Hefurther contended that Imran Khan’s confinement in Attock Jail, followingthe suspension of his sentence in the Toshakhana reference, wasunjustifiable.

Marwat alleged that the notification issued by the Ministry of Law aimed toprolong Imran Khan’s incarceration, suggesting ulterior motives behind thecourt’s transfer to Attock. He emphasized that trials of civilians underthe Official Secrets Act were traditionally conducted in special courts.
