AD&SJ Ghulam Abbas Sial passed the orders while allowing the plea, filed by Humaira Arshad for recovery of the minor.
The court had reserved the verdict after hearing arguments of the parties and it was announced on Wednesday.
Earlier, Humaira's counsel pleaded with the court to recover the minor son of the petitioner from his father's custody and hand him over to the petitioner.
He said that Ahmad Butt misled the guardian court and got orders for custody of the boy whereas he was not eligible to approach the guardian court under the law.
However, Ahmad Butt's counsel argued that his client had already approached the guardian court which allowed him to keep the minor in his custody.
He contended that the court could not pass any further order in the presence of the guardian court orders.
