ISLAMABAD – New developments reported from Supreme Court over formerPresident Pervaiz Musharraf verdict plea.
The Supreme Court of Pakistan has raised objections on the plea against theverdict that nullified the formation of the special court.
Chief Justice Gulzar Ahmed ordered to fix the plea for hearing along withthe objections.
On February 3, a petition was filed in the Supreme Court challenging theLahore High Court (LHC) verdict that declared the formation of the specialcourt unconstitutional.
LHC Rawalpindi Bench Bar Association former president Taufeeq Aif, throughHamid Khan advocate, contended that the Lahore High Court had no power tohear the formation of the special court, praying that the verdict should benullified.
He stated that the LHC had not properly interpreted the amendment toArticle 6. “Pervez Musharraf has been absconding since 2016. For thisreason, the trial was ordered against him in his absence,” he said.
The petitioner said that Pervez Musharraf was given several opportunitiesto appear in court. “The LHC cannot question that decision to try theaccused in his absence as directed by the SC,” he said.
He said that the LHC verdict seems to be an insult to chief justice’sadvice regarding the formation of the Supreme Court. “The LHC judges havenegated their appointment by announcing the verdict,” he said.
Earlier on January 16, former president Pervez Musharraf challenged theverdict of the special court in the Supreme Court.
