This legal decision marks the end of a marital relationship that began in 2012 when both parties were Australian citizens and resulted in the birth of their 10-year-old son, Zoraver Dhawan.
In the courtroom, Judge Harish Kumar accepted the allegations presented by Shikhar Dhawan against his wife and declared that Aesha Mukherjee was unable to substantiate her claims as false.
The judge's ruling was centered on the assertion that Dhawan had endured considerable mental distress due to his wife's actions, which compelled him to live in a long-distance marriage as she resided in Australia, effectively keeping him apart from his son for an extended period.
The court's statement emphasized the suffering experienced by Shikhar Dhawan, attributing it to his wife's actions. It stated that Mr. Dhawan had endured profound agony and anguish, despite bearing no fault himself, by being separated from his own son for an extended period.
Despite Aesha's denial of the allegations and her assertion that she genuinely wanted to reside in India with him, she chose not to contest the claims. The court concluded that Aesha Mukherjee's conduct had inflicted such cruelty, agony, and trauma upon Shikhar Dhawan that it had become impossible for him to salvage the marriage.
