National Assembly passes three bills

ISLAMABAD: (APP) The National Assembly on Monday passed three bills including the Central Law Officers (Amendment) Bill, 2016, the Legal Practitioners and Bar Councils (Amendment) Bill, 2016 and the Code of Civil Procedure (Amendment) Bill, 2016.

Minister for Law and Justice and Climate Change piloted all the three bills in the House.

The statement of object and reasons of the Central Law Officers (Amendment) Bill says that in line with the recommendation of the Attorney General for Pakistan the post of the Standing Council is proposed to be renamed as Assistant Attorney-General by amending the Central Law Officers Ordinance, 1970.

The statement of object and reasons of the Legal Practitioners and Bar Council (Amendment) Bill, 2016 says that for the benefits of the lawyer community at large, it is proposed to bring various Bar Councils and Associations of the country in the ambit of Federal grants.

The grants shall be made having regarding to the total number of Advocates on the roll of a Bar Council or Bar Association and in certain cases keeping in view the requirements of a particular Bar Council or Bar Association in accordance with the prescribed procedure.

Meanwhile, the statement of object and reasons of the Code of Civil Procedure (Amendment) Bill says that under sections 91 and 92 of the Code of Civil Procedure, 1908 (Act V of 1908) in case of public nuisances and public charities, the Advocate General or two or more persons with the leave of the Court, may institute a suit for declaration and injuction or for such other relief as may be appropriate to the circumstances of the case.

The Law and Justice Commission of Pakistan has recommended amendment in the said sections for institution of suit relating to public nuisances and public charities direct with the leave of court without permission of the Advocate General. The amendment will result in expedious disposal of case.
