A division bench comprising Justice Athar Minallah and Mian Gul Hassan Aurangzaib heard the appeal.
Whether the Constitution allow such moves, the bench questioned.
The appellant argued that the Constitution didn't provide ground for this but there was an example of Field Marshal Ayub Khan in the past.
After hearing the arguments, the court dismissed the appeal and termed it non-maintainable.
