Murder case of Benazir Bhutto's prosecutor in IHC

ISLAMABAD: (APP) A citizen, Nisar Ali son of (Late) Ch. Zulfiqar Ali former prosecutor Federal Investigation Authority (FIA) moved Islamabad High Court (IHC) seeking direction for ATC Islamabad to conduct trial of his father on day to day basis.

He apprised the court that his father was prosecutor in Muhtarma Benazir Bhutto assassination case. Zulifqar Ali was murdered on May 3, 2013 while he was on his way to ATC Rawalpindi.

Petitioner informed the court that Islamabad Capital Territory Police later arrested three accused namely Abdullaha Umar, Hammad Adil and Adnan Adil.

Later the accused was granted post arrest bail on July 17, 2014 on medical ground. Later on, the father of the accused Umar Abdullah moved an application before the ATC requesting to stop the trial as his son was abducted by some personals which was accepted by the court.

He alleged that ATC stayed the proceedings contented that until/unless the accused was not arrested/ recovered the court could not proceed the further against the other accused which was quite against the law and amounts to material illegality and irregularity.

Petitioner said, he also requested the ATC to separate the trial of the Umer from other accused but unfortunately court refused to do so. Since then the trial could not be reopened he added.
