The bench headed by Justice Malik Shahzad Ahmad Khan heard the bail petitions of Malik Asif amd Mirza Abdul Rasheed, owners of Alfa Estate and Maymar Housing Service respectively, LDA City development partners.
As the proceedings commenced, the defence counsel Adnan Shuja Butt pleaded with the bench to grant benefit of bail to his clients.
He submitted that LDA City was a joint venture and five development partners including Alfa Estate and Maymar Housing Service were hired for the purpose.
He submitted that his clients were arrested on charges of failure to provide the required land for the project and selling more plots.
He submitted Malik Asif provided excess land then his required share and the same was also admitted by the National Accountability Bureau whereas Mirza Abdul Rasheed assured to provide land for completion of Phase-I of the housing scheme.
However, NAB prosecutor submitted that the bureau did not have any objection if the bail was granted for a period of eight months to the accused.
If they failed to provide the remaining land for completion of Phase-I in eight months, then the bureau would file application for cancellation of their bail, he added.
At this, the bench granted conditional bail to both accused and directed for submission of surety bonds for the purpose.
It is pertinent to mention here that the Apex Court disposed of an application by the Lahore Development Authority for permission to acquire land for LDA city project through the development partners after it was assured that the three development partners including Maymar Housing Service would acquire the remaining land for completion of phase-I of the project.
