India's top Court has no power to hear Article 35-A case: Lawyer

In occupied Kashmir, lawyers including eminent lawyer ST Hussain have said that Indian top court lacks power to amend Article 35 A in the constitution.

Talking to media in Sri Nagar, ST Hussain said, Article 35A is the outcome of an agreement between representatives of India and Pakistan it amounts to Act of State over which the Supreme Court of India lacks jurisdiction.

He said that since Article 35A is the outcome of an agreement this fact has vital bearing on the writs challenging the validity of the Article of Indian Constitution pending before the Supreme Court.

He said the Supreme Court lacks inherent jurisdiction to hear the matter in view of the Privy Council judgment reported in 1859.
